1. Who we are
EasySplit is provided by Educacion Global, Inc., a Delaware corporation ("Educacion Global," "we," "us," or "our"). You may contact us at sos@educacion.global.
2. The service
EasySplit helps users create and manage public storefront pages, payment links, product or tip listings, QR codes, NFC sharing flows, and transaction views. We may add, change, suspend, or discontinue features at any time.
3. Accounts and eligibility
You must be legally able to enter into these Terms and use the services in compliance with all applicable laws. You are responsible for the accuracy of information you provide, for maintaining control of your devices and accounts, and for all activity associated with your account or store.
4. Stores, listings, and user content
You are solely responsible for your store name, handle, profile, images, product listings, links, prices, descriptions, customer communications, fulfillment, refunds, taxes, and legal compliance. You represent that you have all rights needed to post your content and that your content will not violate any law, contract, intellectual property right, privacy right, publicity right, payment-network rule, platform policy, or third-party right.
We may remove, restrict, disable, or refuse any content, handle, store, transaction, or account at any time if we believe it may violate these Terms, create risk, harm users, harm us, or expose us or our partners to liability.
5. Prohibited activity
You may not use EasySplit for unlawful, deceptive, abusive, harmful, infringing, or high-risk activity. Prohibited uses include fraud, impersonation, malware, spam, harassment, illegal goods or services, regulated goods without required approvals, weapons, controlled substances, hate or exploitation content, sexual exploitation, money laundering, sanctions violations, evasion of payment rules, or any activity prohibited by Stripe, Apple, payment networks, or applicable law.
6. Payments and Stripe
Payment processing may be provided by Stripe or other third-party payment providers. We are not a bank, money transmitter, payment processor, escrow agent, marketplace operator for settlement purposes, or financial institution. Payment providers may require separate agreements, identity verification, underwriting, restrictions, fees, reserves, holds, refunds, chargebacks, disputes, taxes, reporting, and compliance reviews.
You are responsible for your relationship with buyers, payment providers, tax authorities, and regulators. We do not guarantee that any payment will be authorized, captured, settled, paid out, or free from dispute, reversal, refund, fraud, or chargeback.
7. App Store purchases
Some app features may be offered through Apple in-app purchase, including Creator Pack. Apple may process those purchases and apply its own terms. Except where required by law or Apple policy, in-app purchase fees are non-refundable through us. Requests related to Apple purchases may need to be handled through Apple.
8. Taxes and compliance
You are solely responsible for determining, collecting, reporting, and paying any applicable taxes, duties, fees, and assessments related to your store, products, services, payments, income, or business activity. You are also responsible for required licenses, registrations, disclosures, refund policies, consumer protection obligations, and export or sanctions compliance.
9. Third-party services
EasySplit may link to or integrate with third-party services such as Stripe, Apple, browsers, web hosts, email providers, analytics providers, or device features. We do not control third-party services and are not responsible for their acts, omissions, availability, security, policies, fees, decisions, or content.
10. Intellectual property
We and our licensors own EasySplit, including software, design, trademarks, logos, documentation, and other materials. You receive a limited, revocable, non-exclusive, non-transferable right to use the services as permitted by these Terms. You may not copy, modify, reverse engineer, resell, lease, sublicense, scrape, or exploit the services except as expressly allowed by law.
11. Feedback
If you send ideas, suggestions, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use them without restriction or compensation.
12. Privacy
Our Privacy Policy explains how we collect, use, and share information. By using EasySplit, you acknowledge our Privacy Policy.
13. Security
We use reasonable safeguards, but no service is perfectly secure. You are responsible for securing your devices, accounts, credentials, recovery methods, and any third-party accounts connected to your store.
14. Suspension and termination
We may suspend, limit, or terminate access to EasySplit at any time, with or without notice, if we believe you violated these Terms, created risk, caused harm, violated law or third-party rules, or if continued service is no longer commercially or technically feasible. You may stop using the services at any time.
15. Disclaimers
EasySplit is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, uninterrupted operation, and error-free performance. We do not guarantee revenue, sales, traffic, payments, payouts, discoverability, compliance outcomes, or business results.
16. Limitation of liability
To the maximum extent permitted by law, Educacion Global, Inc. and its directors, officers, employees, contractors, agents, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, revenue, business, or opportunity. To the maximum extent permitted by law, our total liability for all claims relating to the services will not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid us for EasySplit in the three months before the event giving rise to the claim.
17. Indemnity
You will defend, indemnify, and hold harmless Educacion Global, Inc. and its directors, officers, employees, contractors, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the services, your store, your content, your products or services, your buyers, your taxes, your disputes, your violation of these Terms, your violation of law, or your violation of third-party rights or rules.
18. Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Unless prohibited by law, courts located in Delaware will have exclusive jurisdiction and venue for disputes that are not subject to arbitration or small-claims procedures.
19. Changes
We may update these Terms from time to time. The updated version will be effective when posted unless a different date is stated. Continued use of EasySplit after changes means you accept the updated Terms.
